2. Eligibility

You must be at least 18 years of age to register for and use the Services. By creating an account, you represent and warrant that:

  • You have the legal capacity to enter into a binding agreement;
  • You are not located in a jurisdiction where access to the Services is prohibited by law;
  • You have not previously been banned or suspended from the Services for any reason.

We reserve the right to request proof of age at any time and to terminate accounts where eligibility cannot be confirmed.

3. Account Registration

To access most features of the Services, you must create an account. When registering, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must promptly notify us at support@positivesinglescom.com if you believe your account has been compromised or if you become aware of any unauthorized use.

You may not create more than one account or create an account on behalf of another person without their express authorization.

4. User Conduct

You agree to use the Services only for lawful purposes and in a manner consistent with these Terms and all applicable laws. Prohibited activities include, but are not limited to:

  • Posting false, misleading, or deceptive information;
  • Harassing, threatening, or abusing other users;
  • Soliciting money or financial information from other members;
  • Promoting escort services, adult entertainment, or commercial activities;
  • Scraping, crawling, or otherwise extracting data from the Services without written permission;
  • Attempting to circumvent our security measures or impersonate any person or entity;
  • Uploading viruses, malware, or any other harmful code;
  • Sending unsolicited bulk messages (spam) to other members.

We may remove content and suspend or terminate accounts that violate this section, at our sole discretion and without prior notice.

5. User Content

By submitting photos, text, or other materials to the Services ("User Content"), you grant PositiveSingles a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, modify, adapt, and display your User Content solely for the purpose of operating and improving the Services.

You represent and warrant that you own or have the necessary rights to the User Content you submit, and that such content does not infringe the rights of any third party. You retain ownership of your User Content, and you may delete it at any time through your account settings.

We reserve the right to remove any User Content that, in our sole judgment, violates these Terms or is otherwise objectionable.

6. Membership & Billing

Basic membership is free. Premium memberships are offered on a subscription basis. By subscribing to a Premium membership, you authorize us (or our designated payment processor) to charge the applicable fee to your payment method on a recurring basis until you cancel.

All fees are charged in U.S. dollars and are non-refundable except as required by applicable law. You may cancel your subscription at any time through your account settings; your Premium access will remain active until the end of the current billing period.

We reserve the right to change our pricing at any time. We will provide reasonable advance notice of any pricing changes that affect existing subscriptions.

7. Intellectual Property

All content on the Services — including but not limited to text, graphics, logos, button icons, images, audio clips, and software — is the property of PositiveSingles or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, transmit, display, or create derivative works from any part of the Services without our express prior written consent.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. The health information on our platform is for general informational purposes only and does not constitute medical advice. Always consult a qualified healthcare professional regarding medical conditions or treatments.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POSITIVESINGLES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

10. Termination

We may suspend or terminate your account and access to the Services at any time, with or without cause or notice, if we believe you have violated these Terms or for any other business reason. Upon termination, your right to use the Services ceases immediately.

You may delete your account at any time through your account settings. Sections 5, 7, 8, 9, and 11 of these Terms survive any termination.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the state and federal courts located in California.

You waive any right to a jury trial and agree to resolve disputes individually, not as part of any class or representative action, to the fullest extent permitted by law.
